1. Acceptance of Terms
By installing, accessing, or using the Try It On application ("App"), you ("Merchant," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.
These Terms govern your use of the Try It On Shopify app provided by Try It On ("we," "our," or "us"). The App is available through the Shopify App Store and is designed to work with Shopify-powered online stores.
2. Description of Service
Try It On provides an AI-powered virtual try-on feature for Shopify stores. The App allows your customers to upload a photo of themselves and see an AI-generated visualization of themselves wearing your products. The service includes:
- A storefront widget that adds a "Try It On" button to product pages
- AI-powered image processing for virtual try-on generation
- An analytics dashboard for tracking try-on usage and conversion metrics
- A/B testing capabilities
- Per-product configuration and customization options
3. Account and Installation
To use the App, you must have an active Shopify store and install the App through the Shopify App Store or direct installation link. By installing the App, you authorize us to access your store data as described in our Privacy Policy and as permitted by the Shopify API scopes you approve during installation.
4. Pricing and Billing
The App offers multiple subscription tiers, each with a monthly try-on allowance. All plans include a 7-day free trial. Key billing terms:
- Subscription fees are billed monthly through Shopify's billing system
- Each plan includes a set number of try-ons per month
- Overage charges apply when you exceed your plan's monthly try-on limit
- You can upgrade, downgrade, or cancel your plan at any time
- Cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days' notice
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Upload, transmit, or encourage the upload of inappropriate, offensive, or illegal content
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Interfere with or disrupt the App's infrastructure or other users' access
- Resell, redistribute, or sublicense the App without our written consent
- Use the App to process images of minors without parental consent
- Circumvent or attempt to circumvent usage limits or billing
6. Intellectual Property
The App, including its code, design, features, and documentation, is owned by Try It On and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your Shopify store during your active subscription.
You retain ownership of your product images, store content, and any photos uploaded by your customers. We claim no ownership rights over your content.
7. AI-Generated Content
The try-on images generated by our App are created using artificial intelligence (Google Gemini). Regarding AI-generated content:
- Results are generated automatically and may not always be perfectly accurate
- We do not guarantee that generated images will precisely represent how a product looks in real life
- You are responsible for ensuring that your product images are suitable for AI processing
- Generated images are for visualization purposes only and should not be considered exact product representations
8. Customer Data and Privacy
You acknowledge that your customers' photos are processed by our App and Google's Gemini AI. You are responsible for:
- Informing your customers that the try-on feature uses AI processing
- Ensuring your store's privacy policy covers the use of third-party services like Try It On
- Complying with all applicable privacy laws (GDPR, CCPA, etc.) in your jurisdiction
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The App may be temporarily unavailable due to:
- Scheduled maintenance (we will provide reasonable advance notice)
- Emergency maintenance or security updates
- Third-party service outages (Shopify, Google AI, etc.)
- Circumstances beyond our reasonable control
10. Limitation of Liability
To the maximum extent permitted by law, Try It On shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Try It On, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
12. Termination
- You may uninstall the App at any time through your Shopify admin
- We may suspend or terminate your access if you violate these Terms
- Upon termination, your right to use the App ceases immediately
- Sections regarding limitation of liability, indemnification, and dispute resolution survive termination
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated through the App or via email at least 30 days before they take effect. Continued use of the App after changes become effective constitutes acceptance of the modified Terms.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable commercial arbitration rules. These Terms are governed by the laws of the United States.
